Version 2026.4

General Terms and Conditions for Tenants (Guests)

Amarante Villas B.V.

Version: 2026.4 | Effective from: November 2026

Article 1. Definitions

In these general terms and conditions, the following terms shall have the following meanings:

  • Amarante Villas: The operator of the online booking platform, established in the Netherlands and registered with the Chamber of Commerce.
  • Platform: The website(s), digital applications, and systems of Amarante Villas through which accommodations can be viewed and reserved.
  • Tenant (or Guest): The natural or legal person who enters into a booking or reservation for an accommodation via the Platform.
  • Lessor: The owner, manager, or authorized operator who offers the accommodation for rent via the Platform.
  • Rental Agreement: The agreement for temporary stay that is established directly between the Tenant and the Lessor upon a completed reservation.
  • Booking Confirmation: The electronic overview provided by Amarante Villas on behalf of the Lessor in which all details of the final booking (such as dates, travel sum, payment specifications, and address details) are recorded.

Article 2. Role of Amarante Villas (intermediary platform)

  1. Amarante Villas operates an online platform and acts exclusively as a technical intermediary and facilitator in the name and for the account of the Lessor.
  2. Upon completion of the booking process, the Rental Agreement is established exclusively and directly between the Tenant and the Lessor. Amarante Villas is expressly not a party to this Rental Agreement.
  3. Amarante Villas does not have ownership, factual supervision, or operational exploitation of the accommodations and bears no responsibility for the actual fulfillment of the stay by the Lessor.

Article 3. Realization of booking, prices, and confirmation (no VAT invoice)

  1. A booking is final as soon as the Tenant has completed the booking process on the Platform, has accepted these general terms and conditions, and the required (down) payment has been successfully completed.
  2. All rental prices shown on the Platform for consumers are transparently structured and include any mandatory surcharges, unless expressly stated otherwise.
  3. Booking Confirmation (B2C): The Tenant receives a digital Booking Confirmation by email, including payment specifications. Amarante Villas does not provide the Tenant with an official VAT invoice for the accommodation rental, as Amarante Villas does not provide the accommodation service itself.
  4. Business invoicing requests (B2B): If a business Tenant requires an invoice for the stay costs, the Tenant must contact the Lessor directly. An official invoice can only be issued if the Lessor acts as a VAT-registered entrepreneur. If the Lessor rents out privately or utilizes an exemption (such as the KOR in the Netherlands), no VAT invoice can be provided, and the Booking Confirmation serves as accounting proof of payment.

Article 4. Tourist tax and local levies

  1. Tourist tax, commuter tax, and related local levies are determined by the competent local government where the accommodation is located.
  2. Unless it is explicitly stated during the booking process that the tourist tax has been paid directly via the Platform, the Tenant must pay the tourist tax on-site directly to the Lessor (or their manager).
  3. The collection and remittance of local taxes are the exclusive responsibility of the Lessor. Amarante Villas bears no liability for this.

Article 5. Payments, payment service providers, and terms

  1. Payments via the Platform are processed through a secure and certified Payment Service Provider (PSP) such as Stripe, Mollie, or Online Payment Platform.
  2. Reservations may provide for installment payments (such as a deposit at the time of booking and a remaining payment before arrival), as specified in the booking process.
  3. If the Tenant exceeds a payment term, the Lessor (or Amarante Villas on behalf of the Lessor) has the right to cancel the booking. In that case, amounts already paid will be settled in accordance with the applicable cancellation policy.

Article 6. Security deposit

  1. If indicated in the advertisement, the Lessor may require a security deposit to cover any damage, loss, or extraordinary cleaning costs.
  2. The handling, inspection upon departure, and refund of the security deposit are the direct responsibility of the Lessor.

Article 7. Cancellations and exclusion of right of withdrawal

  1. The Lessor's specific cancellation policy, as selected and communicated during the reservation process and repeated in the Booking Confirmation, applies to every booking.
  2. Exclusion of statutory right of withdrawal (cooling-off period): Pursuant to Article 6:230p sub e of the Dutch Civil Code, the statutory right of withdrawal (the 14-day cooling-off period) is expressly not applicable to agreements concerning the provision of accommodation for a specific date or period. A completed reservation is therefore immediately final and binding.

Article 8. Prohibition on bypassing the Platform

  1. The Tenant is not permitted to bypass the booking, communication, or payment system of Amarante Villas by exchanging contact details with the Lessor prior to a booking with the intention of booking outside of the Platform.
  2. Bookings that are established outside of the Platform do not enjoy any support or mediation from Amarante Villas in any way.

Article 9. Scope of customer service (no 24/7 on-site emergency service)

  1. Support provided by Amarante Villas' customer service focuses exclusively on administrative and functional questions regarding the website, the booking process, and the processing of online payments during regular opening hours.
  2. No on-site emergency service: Amarante Villas expressly does not provide a 24/7 emergency, key, or calamity service. For physical, technical, or operational situations during the stay (such as arrival, key handover, equipment failure, pool, air conditioning, leaks, or calamities), the Tenant must contact the Lessor or their local manager directly.

Article 10. Stay, house rules, and registration obligation

  1. The Tenant undertakes to use the accommodation as a "good housefather" (with due care) and to strictly comply with all house rules set by the Lessor (including regulations regarding quiet hours, smoking, pets, and maximum permitted occupancy).
  2. Organizing parties, nuisance-causing events, or commercial activities in or around the accommodation is strictly prohibited without the prior written consent of the Lessor.
  3. Where required by local legislation, the Tenant shall provide correct identification details upon arrival for the benefit of the legally mandatory night register.
  4. In the event of a serious violation of the house rules or public order, the Lessor has the right to terminate the stay with immediate effect without refund of the travel sum.

Article 11. Complaints, defects, and damage

  1. If the accommodation shows material defects upon arrival, the Tenant must report this directly to the Lessor (or local manager) within 24 hours after arrival, so that there is an opportunity for immediate rectification.
  2. The Tenant is jointly and severally liable for all damage that occurs during the stay to the accommodation, furniture, or the property caused by the Tenant or their traveling companions.
  3. Amarante Villas is never a party to damage claims or quality disputes and bears no financial liability.

Article 12. Review policy

  1. Tenants who have completed their stay will be given the opportunity to post a rating and review about the accommodation and the stay.
  2. Reviews must be honest, factual, and respectful. It is strictly forbidden to use threats of negative reviews as a means of blackmail to obtain unauthorized discounts or refunds.
  3. Amarante Villas reserves the right to refuse or remove reviews that are offensive, defamatory, or factually incorrect, or that violate privacy rules.

Article 13. Limitation of liability of Amarante Villas

  1. Amarante Villas excludes all liability for damage, theft, loss, or injury of the Tenant or their traveling companions, regardless of the cause thereof, during or around the stay.
  2. Amarante Villas is not liable for errors in accommodation characteristics provided by the Lessor, force majeure situations (such as extreme weather conditions, power/water outages), or shortcomings of the Lessor.
  3. To the extent that Amarante Villas should nevertheless be held liable, this liability is at all times limited to a maximum of the amount of the service fee, if any, paid directly by the Tenant to Amarante Villas.

Article 14. Applicable law and dispute resolution

  1. These user terms and conditions between the Tenant and Amarante Villas are exclusively governed by Dutch law.
  2. Disputes between the Tenant and Amarante Villas shall be submitted to the competent Dutch court in the district where Amarante Villas has its registered office, unless mandatory consumer law designates another court.
